What would you do if you paid top price to a dealer and when you opened the box you found this??

I would send it back. Is this a MIB new item? If so then I highly doubt the dealer would have even known about it.
 
Dealer first said it probably happened in transit!!! But he had packed it really well, so he then says he checked it before sending and calls me a liar!!!
 
I have that set and mine had a bend - but not nearly that bad. It seems to be a weak part of that figure and is easily bent.

Sounds like the dealer is not willing to do anything. If you bought it on e-bay using Paypal you will have some protection and recourse

doesn't matter...

I would find a new dealer if mine talked to me like that...

but now I'm curious...did the conversation escalate to "a little hot and heavy"...

thus provoking him in someway before he called you a liar"?

if he won't give you any satisfaction...I would contact the manufacturer...
 
Nope! Not heated on this end anyway, did 27 years in retail and 3 years after closing people still want me back!! Buy and sell on ebay since 2002 have over 1800 transactions and 100% feedback record, so I guess I'm quite easy to deal with. Why did he call me a liar? I guess he thinks I took the figure out of the box and wondered what would happen if i bend the barrel of the rifle like this, oops!!! By the way it was the record business if anyone was interested. If he can't graciously replace it...I would take my business elsewhere...I would also contact the manufacturer...

I can see the foam is still on him in the picture you took...you must not have gotten too much play time with him...

nobody orders a figure to break it on purpose when it arrives...but that's a heck of a bend to get from shipping...

I'm guessing the box it came in was damaged pretty bad too...
 
That's a retired item by the way, from DD 36 I believe.
 
I had trouble with this piece as well. The 1st set that I bought this figure came exactly like yours. A year or so later I saw the same set on ebay at a fairly decent price so I jumped on it. Sure enough the figure came in the same condition. Eventually I found one being sold separately and it arrived in better condition but it still had a slight bend.
 
If you are very careful( I do mean very careful) you could straighten this out and touch it up. Sounds like this happens a lot. I had a similar experience with some stuff. Long story I was pissed but sent the money back. I fixed the stuff quickly but then i am good at it. Good luck, though!
 
I had a problem with the same figure. The set I purchased was advertised as MIB, but arrived with two of the figures badly damaged, including the figure you received damaged. (Apparently, this is a stress point on the weapon that many of us have had problems with). But mine arrived with the grenade extension completely snapped off. This was before K & C was using die cut foam that you can completely recess the figure into. At the time they were primarily using the "egg crate" style, convoluted foam. A lot of these older sets were subjected to the figures banging into one another in transit if they were not carefully packed. Even then, the soldiers don't have to move too far to clang into each other. I also noticed in some of my older sets that there were variations in the convoluted foam ridge heights (perhaps intentional?). In a few sets the foam peaks were very short, allowing for more free movement of the figures in the box than had the foam had taller ridges. Perhaps a bit of over analysis here, but I thought I'd share my experience with you as well as my observations of the older style foam. In fact, I have sold a few older type K & C multi-figure sets that had shorter peaked foam, and instead of taking the risk of having the figures bounce around and hit each other (which typically can be solved with three strong rubber bands around the closed box) I left one figure in the box and packed the others in their own small boxes, carefully supporting extended appendages and weapons/accessories with packing peanut fragments, and then carefully wrapping the individual figures in tissue. I know, these may seem like extreme measures, but better this than to have to go through what you, I and others have had the displeasure to experience. Again, I have only gone to this extreme a few times and that was with the eggcrate type foam in instances where the ridges seemed more shallow than was typical. Thankfully, as far as I know, K & C no longer uses this style foam. I believe they only use the die cut style now that has a slot in the foam the same shape of the figure that it fits firmly into. The depth of the recess is deep enough to cover the whole figure and is much more effective than the eggcrate foam.
The good news is, I think your figure can be repaired. There are many skilled folks here on the forum who would probably be more than happy to assist. I would just very carefully bend it back straight. The paint will be cracked at the stress point (most likely all the way around), but it can be fixed. Hopefully, it won't snap on you in the process. You may wish to hail the services of The Kilted One, the Vampire Field Surgeon known to us all as KV. He buys broken stuff just so he can restore it to like new or better condition! One final observation of mine, K & C weapons are very soft, so they are more likely to get bent, but they are also more often repairable than say harder materials like fine pewter or alloy metal compounds that would've just shattered rather than absorb the shock and/or contact. I hope this helps! This happens to pretty much everyone from time to time. And don't let the guy calling you a liar get you down. He's just a creep, whoever he is. Just get a medic for your soldier, and leave that seller in your rear view mirror; he's just a bump in the road.Don't let him spoil your enjoyment of your collection!:) Joe
 
My concern would be that this is not a transit issue. That bend is not caused by bumps etc as the box would have to be damaged by the impact. Its easily fixed but, you should not have to in an ideal situation. Use all the financial protection you have to get compensated.

I always think MIB is fine never believe that a bona fide dealer would not open and look at the merchandise to check its condition. Its just so obvious a thing to do. Its not smugness but, its why I would only ever buy from K&C UK or other reputable companies who sell disco stuff.

As for calling you a liar well, if that was not due to anything you said then I would not use him again and ensure he was exposed for his unprofessionalism and, then set the dogs on him

With a lot of the older sets in the green boxes, K & C would add pieces of drinking straw on exposed points and put a rubber band around the box. If the band is on tight, no damage should take place. However, when I've sold some of these sets, I've wrapped figures separately, as Joe has, to avoid damage. At the prices these sets are selling for, you can't take any chances. Also when I pack a box, I shake it. If I can't feel any movement, I know it's securely packed.
 
Many thanks to everyone who has posted replies to this thread, I'd never ever used forums up to joining Treefrog's and it's been a great help, so thanks again. Re. the figure, I reckon I can now safely assume that the seller did one of two things; 1..He never checked the contents of the box at all, or 2..he checked and knew about the damage (as it was clear to see when I lifted of the top layer of foam) and decided to go ahead and send it anyway, what with him being in the US and me being in N.Ireland. I have politely asked him to do one of the following.
To refund the payment plus return postage at which point I will within 24 hours ship it back to him. Sadly I no longer have any faith in the seller to send it to him without being re-inbursed first. Or second choice, refund $60 to cover the costs (slim as they are) of trying to obtain the figure if ever it comes up for sale here or on eBay.
Again I'll let you all decide on weather I'm being fair or not. Thanks everyone.
 
Seller has been reading all your helpful comments and has refunded $60 a few minutes ago. Now the search begins for a replacement.:) thanks
 
For what it is worth, I always try to buy with a credit card.

In any case you receive a product that was not well advertised, or the price that was charged was not the one you agreed on, you just have to send your proof to the credit card company and they will refund you. And then it will be the seller who will have to prove his point to the cc company.

But then again I had to do this only once with bottles of perfume where products in the shopping cart were in $CDN but then they charged me in $US AND added a conversion fee to the transaction in addition to the fee of my cc company ! A quick call to the seller did nothing but mastercard just asked me to send them a screen snapshot of the cart.
