FWIW, when I sell a figure on eBay, I make sure that I have enough lighting in the room so that the figure in the photo looks like the actual figure. If the photos don’t, I trash them and re-shoot them. Was the seller negligent in taking photos that didn’t look like the actual model? Possibly...
Based on George’s comment I think a good case can be made for both buyer and seller and in such a case I think it’s entirely possible that eBay will side with the seller but why not try anyway. Nothing to lose.
