Hi Guys,

Thought I’d take this opportunity to give you some feedback and comments on various Forum Posts…

1. More U.S. Figures for Normandy?
Undoubtedly yes… we will do more for Normandy however it’s worth remembering that it was not just Americans who landed on D. Day… Just last year K&C produced British and Canadians… and I would like to do some more!
For many years we concentrated almost exclusively on Americans and Germans it’s nice, for a change, to design British, Canadian and Free French.

2. Compliments
On behalf of all of us at K&C a great big thankyou to everyone who posted their very complimentary remarks about us.
It’s very much appreciated and we will continue to do what we do to the very best of our collective abilities.

3. The One K&C set you are missing…
Actually there’s more than a few we’re missing back here at K&C HQ in Hong Kong… for instance…
A. The earliest wooden, carved in China, Sherman, Panther and Tiger.
B. The Royal Horse Artillery Mounted Gun Team.
And that’s just for starters…

4. The Return of 21st.Century
I was (and sill am) a big fan of 21st.Century and their products. A few years ago I was fortunate to meet Jim Allan (the founder and CEO) of the company. So, I hope this new start-up company “ALL-GO Toys” is indeed 21st.Century under a layer of cunning camouflage.
A couple of small points though on their website they say they are “AMERICAN-MADE” and then indicate they are an “American owned and managed company”. Whilst I agree with their second statement I would bet my bottom dollar (US that is) that their products are manufactured in China just like most others (including K&C).
Also, from a U.S. legal stand point if a company goes under (as 21st.Century did) can the same people start up all over again doing basically the same business but under a different name in a different State?
Good luck if they can… what do the lawyers among you say.

5. And another thing…
K&C just passed the “80,000 posts” mark on the forum so… I suppose we must be doing something right… at least occasionally!

If the new company bought the rights to the name they can. Otherwise, they would probably be infringing their trademarks. I suppose it's possible that the new company could have filed an action for non use and if you are not using a trademark, your registration can be cancelled.
 
When you've been a transactional attorney for lo these many years, selling off obsolete assets, you pick up a little IP knowledge here and there.

I did a very quick search on 21st century and it sounds like they either filed for bankruptcy or sold their assets. In bankruptcy, in order to pay the secured creditors, the trustee would have probably sold the assets (including any IP). If they sold their assets outright, it would have also included any IP.
 
re: reorganizing 21C.

haven't had this confirmed but in model railroad circles there is an urban legend about a gent who organized a hobby importer and began to carry the line of H-O scale passenger cars produced by Rivarossi in Italy. After that one went bust he organized another company, got the contract from Rivarossi again. Each time the partnership ended with Rivarossi being owed a large amount of money for products produced and sold in the USA. So apparently a bit of creativity and manipulation will allow you to run several companies in to the ground.

I DO hope that the 1/32 products see the light of day again. I would really LOVE to see the US Army Dodge trucks that were produced in 1:18 be done in 1:32 size. Here's hoping.

Congratulations to Andy on hitting the 80000 post mark! :eek: I too would welcome more additions to my Commonwealth D-Day forces in both troops and vehicles as proposed in this thread. Lastly I think the potential reemergence of a low cost ( and quality ) toy soldier manufacturer is good for this hobby. Currently there really isn't much for the low end purchaser and by having a low end manufacturer it allows for new entrants to the hobby. I know for me thats what got me started many years ago. Ultimately their reemergence probably helps K&C in that respect more than it hurts them.
