Been buying up photo albums-need advice (1 Viewer)

Hey all,

I am on a break from collecting my tin tanks and have moved on to something else: German wartime photo albums.

Seems that I always find and see American albums while there is a totally different side to the story. Also, these must be failry rare and I could potentially copy right the images, make up negatives and allow people to use them for books and such, research or ideas for figure/vehicle production.

When I receive this first batch of them, I may need help id'ing some stuff, some people, places and such.

Can anyone here help?
 
Should have been collecting those three years ago I had an extensive collection of original complete german uniforms from head to toe, medals helmets etc....Ialso had approx. 70 german photo albums 90% of which were taken in the field during combat from Russia to France...troops tanks planes vehicles, the dead etc....always thought I was going to do the same as you but it never worked out...have fun collecting them they are great!!!!!! I had a few photo albums that came with the guys medals and papers dog tags and other personal stuff from the famileis, wounded three times in Russia then was killed had death certificate as well...I really miss alot of it...I have many photos of my old collection that I have since sold and wanted to share them with you guys but don't have a scanner...too bad you guys wouldn't have believed it..... collected over 15years since I was 17 and don't have one item left.......:(

Now I have stooped to collecting reenactment uniforms for the Napoleonic era because I couldn't afford or find a real one....:eek: maybe 10,000 for a tunic.

I'm not going to get into uniforms. I really have no place to put them. But the album thing would be great. I am getting them for relatively cheap - I gather from 10 - 400 depending on subject matter is pretty fair to great as far as pricing goes.
 
I have a quite large German WWI and WWII collection of misc. medals, knives, ammo, buckles, etc. but some of my favorite items are the photo German death/burial cards.

You can't copyright these; the images don't belong to you. They belong to the person who took the picture, whoever that may be. Unless you have a waiver from that person, you can't use them without his or her permission. As a practical matter are you going to get this and is someone going to come after you if you don't? No and probably not. But if you start doing something for people to access, as opposed to your private use, you are talking about something else and I would tread carefully without having that permission. I did this for somebody else recently and we came to the conclusion that you needed the photographer's permission.
 
I took a look at what you're looking at. I found some others. I'll post some links. Gid, do you read German?

Yes, I can read German to some extent and for what I can't read I can use a translation program in ms word....

I see this sort of stuff a lot on Ebay and they can be pricey. But they are a wealth of fantastic information on the day to day lives of a field soldier. My wifes land lord in Germany was an NCO in the German Army during the war and he had a few pictures and gave us one which we have framed and displayed. He told us that he lost nearly all of his pictures due to the fighting at the end of the war that destroyed his parents home in the Kaiserslautern area. I would have loved to see them because he was in nearly every major fight they had including the opening invasion of France and then Russia. So if you can find them they will be very interesting. As for the copy rights speak to a publisher in NYC and see if they can point you in the right direction. For some pictures you may need permission from the family or the estate unless the ownership is unclear. But do the things you need to do to protect yourself or else you could get into some very hot water.

I have about 6 on the way and I'm bidding on a bunch more. Let's see what happens.

The one thing I don't understand is if these peoples' liknesses are not copyrighted then what would the problem be?

In most cases, these soldiers are no longer with us, passed away and such.

I'll take up that advice and contact Osprey or the History Channel and see if they can point me in the right direction.

As you know I am an attorney and somebody asked me the specific question about the copyright rights of photographic images, even those made 50 years ago. I checked with a copyright attorney and the results of the advice is posted above. You have to be careful. Is the likelihood of someone coming out of the woodwork high? I would say not but it can happen and if you use someone's images without permission, you can be liable. It's up to you if you want to take the risk.
