Please can I clarify - Are pics posted here copyright of the poster or the website?
 
I believe they belong to the poster, assuming he has copyrights in them. In your case, you do.

I assume this question comes from a specific concern.
 
No specific concern Brad, just a question arising from a conversation with a friend in a different context and website that did claim copyright. A good way to stop all contributions IMO.

Is there some terminology in the use of the Forum that states that original photos of a poster are copyright? And can that be done with just a statement by the Forum?

And wouldn't quoting that photo in a reply to the post infringe that copyright?

Under the fair use doctrine, quoting a pictiure or some other content in which a person has copyrighted or to which a copyright has attached should be permissible.
 
The copyright issue has gotten sticky with the internet. All too often, once something is digitalized it becomes almost impossible to control. Legally the original photographer still has the copyright, but many don't pursue the issue because of costs. One does have to be careful about posting copyrighted material, it could come back to bite you. I consider that when I submit photos to the forum. On the good news, US government publications aren't copyrighted, which includes the Army Signal Corps photos.

As I am not familiar with US copyright law, I wrote to Shannon back in early 2009 for advice on the posting of images from the internet.

Here is her reply in summary:

She believed the ‘fair use’ act applied in that there was neither monetary gain nor commercial use involved.

As long as the image was not labeled as ‘not to be used without permission’ it would probably be okay.

If someone contacted her complaining their images were used against copyright, she would remove them from the forum.

She advised to credit the website from which the image/s was taken.

I shall let Shannon expand on this further.
