I need advice from you all. For the first time ever, I failed to receive my package from an E-Bay dealer. He used FedEx as a service and FedEx shows the item as delivered, including a confirmation photo of the package on the ground where it was delivered and info that included package dimensions and weight. There was no package at my apartment door. Now the problem. The photo is not of my entry way/door/hallway. It clearly shows a tile entrance way while my doorway is in a carpeted area, so the package might have been left in the general public area of my building. Further, the photo clearly shows a package of large dimensions, but very thin. FedEx dimensions were recorded as 35"x31"x only 2" deep, and the photo confirms this. I ordered 3 books that would noway have been sent in a box of this size. They simply wouldn't have fit. The package shown in the photo is obviously for a picture/poster/or whatever with large side measurements and flat. My package would have been much deeper and square, a regular book shipping box. In communication with the seller, all he says is that FedEx shows delivery and everything is ok. He has not answered my questions in regard to the package dimensions that he sent. FedEx claims delivery, the seller claims delivery, but has not responded to my questions about package dimensions. Even if the package was stolen, obviously a possibility, I don't believe it was the correct package. I also suspect it was not delivered to my building but can't prove either other than the obvious evidence of the FedEx photo showing an incorrect package and possible incorrect location. Should I pursue a refund through E-Bay or just eat the loss as a stolen package? How does this all work with E-Bay and the dealer? Thanks for any help. -- Al

I would definitely contact eBay and tell them exactly what you just wrote. Hopefully, they will process a refund. I would also tell FedEx the same that, yes, it was delivered but not to me.

I had this happen to me but as a seller. The buyer said, yes, the cd had been delivered but not to him and that the PO was unwilling to help. My initial reaction was that’s not my responsibility but as the seller chooses the means of delivery, the onus is upon me. Ultimately, I sent him a different cd and he was happy.

Thanks, Brad. I suspect and would expect, that neither the seller nor FedEx are going to be interested in going further as the package shows delivered. I will probably just file an E-Bay claim even though I suspect the package was pilfered, but I also suspect an error occurred in shipping and that I would have received the wrong package anyway. -- Al

Interesting development. According to instructions by E-Bay, I had to wait until today (3/31) to further my complaint about the missing package. I woke up and was getting ready to do just that when I got an email from E=Bay saying the seller had already provided adequate info about delivery and that E=Bay had already decide no refund would be forth coming. How did I manage to lose a process that I hadn't even been allowed to start? Don't know what to do now as the case has been closed and ruled against me, all while I was dealing and communicating with the seller in good faith. I just don't get it. -- Al

You need to call them and talk to a person and explain the circumstances. Maybe that will help.
