I have a question for you...

I just received something from ebay. it was listed as "like new" w/out box. I got it this morning. It is an aeroart trebuchet with two figures. The end of the trebuchet is broken off and the end that's left is glued down to the frame. This definitely isn't like new, but when i looked again at the photos, you can see that it is broken off. So, do I just chalk this up to I should have looked closer or do I rely on the wording that said like new? For those who don't know me, I hate to deal with conflict so want to get a feel for what others would do in this situation.

You should send the seller an email, indicating that is not like new, the reasons why, and request a refund. If you don't hear from him in three days, send him a follow up, indicating that you're planning to file a claim with eBay by the end of the seventh day.

In my opinion, like new is the same as saying near mint, which this item is clearly not.

P.S. You hate to deal with a conflict? You're an attorney. Conflict is the name of the game for us! ^&grin

but let's just forget the selling description for a second...

"like new...mint...perfect"...etc...

it arrived broken...and that was not the description...

that falls on the seller...

if you're not going to be happy with a repair...
and I probably wouldn't either on an Aero Arts set....
then follow Brad's advice...

Paypal will support your refund with the documentation from the advertising photo that shows damage...

There's an element on Ebay that will do stuff like this. On the face of it, the situation that you describe makes no sense. Why would the seller do something like this? Ebay has its stock definition of "New" and what you describe certainly doesn't appear to fit the bill. And the seller knows that you have effective recourse via Ebay in seeking a refund. However, the seller also knows that MOST people don't like to return items. Armed with this understanding of human behavior, a bad seller can count on a BIG chunk of what are essentially fraudulent transactions going unchallenged. Even if he has twenty-five percent of his sales returned, he's still making money over what might be realized if the item description had been accurate. He loses a few, but wins a lot more in the long run. Dealing with people like this makes me completely crazy, BTW, so much so that I don't do much buying on Ebay. My advice would be to politely go for the *-whit's throat. He may well offer you a partial refund if you keep the item, but I'd make him eat the whole transaction. In addition to a refund, I'd also seek compensation for the return shipping. Remember to be polite in your communications with the seller. Ebay puts great stock in how you communicate in the course of a disputed transaction. Let us know how things turn out.

Ok - I just requested a refund - we'll see what happens

I don't think this is necessarily a bad seller. He said the collection was his father's and I don't even know if he knows that the end of the trebuchet is missing. That being said, it was still a mistake to list it as new (but I knew it wasn't new, so that's not really my issue)

Also, one of the figures is supposed to be holding a hammer. The hammer is missing. It would appear that nothing in the set is like new, quite the opposite really. I hope the return goes smooth.

Had the same problem with a russian seller. He sent me the wrong figure, another time a figure with paint loss.. I had to resend him the figure while paying for return shipping..
I was a repeat customer. He put me on his ban list !
So beware, some people are too susceptible.

Well, I got my money back and everything went smoothly. What irks me is I just looked on ebay and he listed it again as "new"!
And here I thought we found an upstanding ebayer!

I've reported sellers for such transgressions in the past to no effect. I've also reported sellers for soliciting sales outside out of Ebay. Same deal. This led me to conclude that Ebay doesn't really care. It get's its piece of the action when the item finally does sell, and that's its ultimate concern. While I appreciate the "money back guarantee," it's still a pain as far as I'm concerned. And as I stated earlier, it's a simple fact that a significant number of buyers will not return an item, fraud or no fraud. At one point, I returned three out of four consecutive purchases because of discrepancies in the description. The real shame of it all is that there are some scrupulously honest and service-oriented sellers on Ebay. However, the bad apples can really leave an awful taste in your mouth.:redface2:

Hi,

I just wanted to let you know that after receiving the item back it was damaged. The piece you mentioned that was missing was not missing at all. This piece is a collectors item, not a toy. It is not meant to be played with or work like an actual trebuchet. I was not happy to see that you literally ripped the rope off the trebuchet. I just thought you should know that you were the one who damaged the product.

And now she took down the listing. i wanted a screen shot to show the relisted item looked the exact same as the item I purchased - ie, no new issues!
I give her credit - smart to take it down before sending me that message!

Do I ignore this or warn Ebay there might be an issue? No report as of yet from her

What a s£¥£¥€ seller !
Buy it's not only on ebay that stuff like that happens.
many years ago, I bought a dozen FL figures from one member on TF and 4 were damaged.. But not the kind of damage that occurs in transit. And the figures were described as 'new'. Since i asked the seller to ship the figures 2 months after the purchase (i was on vacation), i had no recourse using paypal..
This member is not a TF member anymore.
Won't buy anymore figures from people i do no trust.

I reread the thread, and realized that you did receive a refund.

It's a shame that you had to endure an encounter with such a scumbag.
Apart from some inconvenience, however, I don't think there's anything else that gliss0122 can do to you.^&grin
