I bought an item nearly 4 weeks ago and I have never heard from the seller about if he has shipped it yet .
I have emailed about 5 times to ask if he has shipped but still no reply
How long should I wait before contacting ebay

Scott which country did you buy it from mate as if it from the USA it could take that long but if I where you I would contact ebay mate :salute::

I would contact them and open a case. I have never had to wait four weeks for anything from the US and as he is ignoring you by the sounds a case will certainly make him reply

He hasn't even put it up as despatched
Yes it was from the states
I have bought from him before and the set was despatched in a couple of days and the set was mint
I will give it to Friday and if nothing I will contact Ebay

If you've attempted to contact him 5 times, and he hasn't responded at all, I'd open a case with eBay.

If you've dealt with this guy in the past, that could carry some weight, but I've seen vendors who were regular and reliable go AWOL when something bad happened in their lives, so, you have to decide. I'd open a case, at this point.
