Hey guys, you may remember me putting up a thread about me winning a WSS16 Tank Crew on the 21st Of July?

Well it just arrived today, two months after purchasing and paying for it!

And the seller described the condition as 'Used', however he failed to mention that all the figures of the men were chipped, the barrel from the sitting figure is quite out of shape, the gun under his arm was bend and falling off, and the tip of the man's shell casing was chipped too!

He also failed to mention that there was no box!

I paid US $232.50 for this set, as I was led to believe it was in at least good condition, and that it was boxed up!

Some sellers need to better describe their items when putting them up for sale on Ebay!:mad::(

Just e-mailed the guy there, even my mum is not happy, he will hopefully reply shortly!:confused::mad:

Is there anything I could do?
Any money back clause that is open for me?
 
I think I would file a claim with paypal (assuming that's how you paid for it). Based on what happened to me once as a seller, paypal will freeze that amount and open an investigation. Hopefully, you'll get some satisfaction, either a complete or partial refund. Good luck.
 
Wow! Sorry to hear about your misfortune I hope everything works out for you.
 
I would first contact the seller and advise him of the problem and see what he says. If you get no satisfaction file a claim with paypal and as Brad says they will freeze his account until this is resolved.

If you put a claim in with paypal your get your money back but your need to send the item back ,or you could take a part refund

You really need to file a claim with paypal - item not as described.

That is truly unacceptable - none of that being described.

I hate a lot of what eBay has put in place against sellers but I suppose this is the scenario they were thinking about when they did.

Don't wait too long for his response before filing a claim. I don't know how long a time period you have to put in a claim - perhaps someone could post that.

I am glad you received the article. I apologize but I have no boxes from any of the old sets and put it down as used as well. I am at a loss. The WS 016 was in great condition and it did not have any chips. Also, none of the figures have a gun so I am not sure what is falling off. Are you sure you are talking about my pieces.



But, as I am a collector of these I can understand if they were chipped you would not be happy with them. I would not want you to keep them if you were not 100% happy with them.



Please tell me what you would like to do. If you would like to send them back I would be more than happy to refund you 100% (even though I stated no refunds). If you would like a refund I could understand that as well.



My goal is to make you happy with these if you want them. I received 3 e-mails after you won these from other bidders asking me to let them know if you did not pay for them. I really do think these are special pieces.



Is it possible to send me photos of how they arrived (chips and gun falling off). I would appreciate that.

Scott you should be 100% protected by Paypal, and Ebay has a no-questions asked refund policy.

I would contact ebay and they will advise you what to do. If they tell you to file a Paypal claim you will receive your money back which will leave you free to purchase something else if you like.

I would inform the seller what ebay tells you to do so there is no problem. If a claim is filed it can be closed once your refund is issued.

I bought a gold coin a couple of weeks ago and when it was not to my liking I contacted the seller and advised him I would file a claim for my own protection. He issued me an immediate refund trusting me to return the coin.

Don't worry, you should receive a complete refund!:)
 
Oh by the way time limit to file a claim is I believe 45 days from date of auction.:)

Please PM who the seller is, I am very curious as I often scout old K&C and I don't want to deal with someone who blew the call this badly.

You have my total sympathy. E-Bay has become treacherous in recent times. I know a lot of buyers and sellers who have totally given up dealing with their "new improved" system and mandatory use of Pay-Pal. Unless I can conduct a positive assessment of a seller's feedback record, I won't even consider bidding. Even with that I have found some dodgy dealers, who's modus operandus I describe in some guides, see below. I have a reasonably sized collection of vintage W. Britains, which I started as a kid in 1947. As hopefully an aid to both seasoned veterans, as well as new collectors, I posted a guide for Britains on e-Bay a couple of years ago. At this point in time I only buy them mint in the box from an authorized dealer, at the store where I can physically inspect a set before purchase.

John, the auction was July 21 in Scott's post - almost 60 days so it is likely the 45 day limit has passed. The Vendor says in his e-mail that he is a collector but did not know the seated figure had a gun, which he clearly does in a photo of the set.

Is there an e-bay provision for a claim if it takes longer than 45 days for the item to get to the buyer?

I have been on e-bay for about 8 years and have about 90 purchases without a problem, but even so, I have become increasigly wary recently about bidding on any old K&C items unless I know who the vendor is. In the past, I have purchased some $200 - $300 items from vendors who were not regular sellers of K&C figures or not regular sellers of expensive items (i.e. a one of type of sale) but I would not do that today with the current e-bay system. I like to know that the vendor has a long and good reputation and knows the product he is describing.

I one time had a claim that I had not received an item and it was over the 45 day limit. Basically ebay/paypal told me I was s*** out of luck. :mad:

I wonder if the seller knows this and is expecting Scott to send it back then not issue a refund (knowing Scott won't be able to do anything about it as 45 days has passed) Seller then has the set and the money.
Sounds a bit OTT I know but the guy did say he was a collector and didn't know the figure had a gun. I am curious as to why it took so long for Scott to receive it?
 
If you paid by credit card through Paypal, you have recourse through them even if you are past the Paypal statute of limitations.

Terry thats really a tough one. I would never allow 45 days to pass without the item arriving! I would always recommend filing a non-receitp of item claim long before that. Claims can always be closed if everything turns out OK!
