Seller cancelling auction on EBAY (1 Viewer)

I recently won an auction on EBAY for a WB Camel mounted bugler. The retail price for this item is $90, however, I won the auction for $58. Now the seller has asked to cancel this auction because the item is "out of stock." My feeling is that the seller wanted more money for the item and now he wants to void the sale. At least this is my gut reaction. Has anyone else had this problem?

I had this once with an Italian seller, saying he had found some damage on the items. Since he obviously didn't want to sell it and it would have been coming from Italy and he could have said I mailed it but sorry it got lost in the mail, I didn't push it.

However, in your case, since this is a US transaction and Paypal protections are stronger than a few years back, I'd file a complaint with eBay.

I was watching that item, and I know the seller. I have bought from him before, also at a very low price, so I don't know if price was the real reason, though i would not say it is out of the question. I would pester him a bit, then ask if he would just substitute another camel or mounted figure. If he refuses, it is likely about the money.

I have already filed complaint with EBAY. The seller cancelled my purchase, for $49.99, on the grounds that the item was out of stock, however, this item is available for purchase, $79.99 on his EBAY store. I have a screen capture with the date on it. I have previously purchase products from this vendor without any problems. After this episode I will spend my money elsewhere.

Hi Benjamin,
I sympathize with you, this does happen for a variety of reasons, some legit, some not so as it appears in your case. At the end of the day, you have to determine how much energy you want to put into the quest! I think your last sentence is best, spend the money elsewhere, there is usually nothing postive that comes from a forced sale (even if you are in the right).

Given the economy and the amount of products available at reasonable prices, it is not worth pushing the issue.

It has been my experience that this type of shenanigan happens a lot. Usually it's because the seller has received a higher offer (privately) and while he can't explain to eBay that's he's accepted a private offer for a higher price, he simply clicks on one of a number of legitimate reasons to end an auction early from a Pop-Up window and ends the auction. Is it not better to actually push the issue and force the sale. I cannot see how its not beneficial?? certainly not for the buyer. TD speaks from experience on e-bay as a seller but, its a legally binding contract. its an auction and, I have seen on here a number of sellers who moan and groan when buyers allegedly mess them around as if they are saints and every buyer is either stupid or, criminally inclined. The same applies here sorry but, I would not let it go and, step one would be to leave feedback clearly showing this and, then contact e-bay.

It seems to me that there are as many stupid and criminally inclined sellers as there are buyers. The civil courts are filled with actions where a deal is struck and then someone backs out because they either got it cheaper or, were offered more. Thats what contract law is in place to stop

There really seems little effort to pursue this matter a few e-mails its never happened to me before but, I would not allow it to. Once the hammer falls deal is done really tough luck if you were offered more or, could have got it less elsewhere

My point on forcing a sale. You force the sale, let's say it somehow breaks in shipping. Great, now you are out time and you have to file a complaint with an already unhappy seller. You file and you ship it back and actually win. Now, they refund you your original purchase and shipping, but guess what, you are out the return shipping and your time. What did you accomplish?

That is why I say , some things that are not meant to be or are too hard to complete usually don't work out.

Does it look like the seller is a jerk in this case, sure, but just speak with your wallet and don't frequent them no more so to say!

Getting satisfaction from ebay is not going to happen. THey don't care at the end of the day.

Again, my opinion and I live by the philosophy I only spin so many windmills in one year!

You have more knowledge of e-bay in your country than I do but, I am wary of this seemingly highlighted accidental damage which, seems linked to forced sales. I don't care if we contract a matter its black and white. If one party pulls out for spurious reasons which, are not legal then, you face the consequences IMO. Your coming from the seller stance which, you clearly often state. I would as a buyer in this case not be one penny out of pocket I assure you as I refuse to pay return fees for items that are either broken or, come in a different manner to what is or, has been desciribed. I have had three broken items from E-bay and the seller has either footed the return bill or, refunded me the price and the item is binned. Its what I would do as a seller why should the buyer be out of pocket thats rather unfair. If I send something I take pictures of the item with a dated camera and insure the item fully. If its damaged then its down to transit and, I would put a claim in its not the buyer who does this. However, thats the norm in e-bay selling or, the correct and decent thing to do. Thats not the issue here at all and you know what is happening from what is stated. You may not be wishing to blow etc at windmills but, I think the small effort were it me, would far outweigh any negatives.

Dodgy people need to know that they will be called on their actions or, they just continue with shoddy practices.

I've had the same happen . . . gave a seller a bad review for several insulting answers to reasonable requests and he cancelled my next winning bid. (He did return the money.) An eBay investigator assured me that my queries were polite and reasonable. but wouldn't punish the offender. My take: money speaks louder than actions.

I do fully agree and look at it as a buyer as I do not practice in this manner as a seller. I am only saying from personal exp as a buyer that even when you are in the right it isn't worth it. But trust me I agree with you.

Out of stock. ??? Then why was it listed for sale in the first place. ??? E-Bay should give this seller a warning and if it happens again..........YOUR OUTTA HERE. {sm2}

Either way I would give him a negative Feedback and not buy from him again.

I thought that was the chance one takes with E-bay. It may fly or, it make go for pennies. its the luck of the draw but, I agree about leaving exact feedback so allowing others to be forewarned of the actions either intentional or, by error or negligence.

In case the seller is on here I also have no idea who it is but, these are my thoughts irregardless.
