What about members pictures of diarama/setups ?
Didn't FL use Franks on it's site,personally I would find it a compliment and accept a free tank or two lol.

Members photos can’t be used without their permission. If you’ll notice, Zach Lang has a copyright logo on his photos although in the US you don’t need the “c” in the circle for copyright to automatically vest.

Some may not find it a compliment if their photos are being used by a manufacturer to sell product without compensation to the copyright holder.

Brad, I believe it on the photos. One time very early on ebay, I used a manufacturer publicity shot as it was an old collectible line, long retired and that was the only stock photo. Believe it or not, the original retailer in Williamsburg was trying to dump inventory and tried to assert that i used "Their" photos without permission. Having not knowing *** they were talking about I apologized UNTIL I did more homework and found out they were only a retailer with the same rights as me to the photo. Well, the jerks reported me to ebay in the meantime and wanted compensation for a $50 item I sold (mine sold, theirs didn't). Eventually I actually found the manufacturer, they thanked me for letting them know, they actually even called Ebay at the time to refute the retailer's claim to the photo and I was out of hot water. I am sure you can imagine my further reply to that retailer. I tore them a new rear end and had a lawyer friend of mine send them a letter indicating they were unlawfully harrassing me through email and voicemail. As i look back on it, it was comical, but at the time, it was slightly unnerving. I truly believe that retailer was losing their mind and business, they went out of business shortly thereafter. I just chalked it up to Kharma.

My favorite thing on eBay is when one of my photos (and as brad says, I know bc I label them) was used to sell a figure that I had commissioned to be painted - well, sorry buyer, but it’s one of a kind so I promise that isn’t what you were buying.

Most times a store or manufacturer has used a photo of mine, they have asked. I don’t take the photos to make money and always allow it. I am in the “it’s flattering “ camp

Yup, have seen this and I crack up since I know your figures!!!. My other funny and I can point to numerous are the way I photo my ebay items, you can find other items where my photos are still being used. I don't care of course, but I do feel that any buyer should know that is NOT the item they are getting! I only use actual or factory stock photos (if brand new).
