If I receive an item that is damaged and the seller request it be returned who has to pay for the returned item? If the seller must pay do they pay me first before I reship it or do I ship it and request them to repay me?
 
Depends on the listing and what you can agree upon with the seller. There is no one answer.

HE PAYS POSTAGE...

again...

I would ask for pre payment shipping or a return shipping label before I ship it back...

ex:
I order a shirt from Palais Royal...
it comes with one sleeve missing...
Palais Royal requests you to send it back...
of course they pay return shipping...

why would there be any discussion on who pays return shipping...
it's not as advertised...
 
Actually, that’s not necessarily true. For Amazon returns, unless you drop it off with UPS, you pay. However, we’re talking about eBay and as a matter of contract law it all depends on the listing and what you can work out with the seller, unless eBay has a policy mandating the seller pays for returns.

Go back and read the terms in the listing. As Brad (jazzeum) has said, there is no one answer. You agreed to whatever terms are listed in that auction when you bid. That is the place to start.

If I sell someone something on Ebay and it is not the correct item, is not as described or it arrives damaged and they do not want to keep it, I will pay to have it sent back.

If it arrives damaged and the buyer and I work something out where he agrees to keep it with a rake off on the price, then all the better, have had that happen a few times. It sucks, it's better than taking a total hit on a damaged item. I then file a claim with USPS to recoup some of the cost of the item as well.

If someone buys something for me and it's the wrong scale, there is a defect in their eyes, the box or clamshell has a scuff on it/crease on it/dent on it, or they "don't like it" and they want to send it back, postage is on them, no exceptions, end of story.

on all my listings I have..

Returns: Seller does not accept returns (see details)...

when you click on "see details"...

it says...

You are covered by the eBay Money Back Guarantee if you receive an item that is not as described in the listing.
 
Let me tell the story behind why I posted this in the first place. I won 4 seperate auctions from one seller all at the same time. Postage on each was $8 so I requested an invoice for combined shipping. Each item was a McFarlane 6 inch figure in a clamshell box The seller replied she would not combine shipping because from her home, W. Virginia, to my address St Louis, Mo. would cost $32. I contacted ebay to see what my options were and they replied if I did not pay and got some bad strikes against me they would remove them because the seller should have combined the shipping. I then responded to the seller that postage was way to much and to cancel the order that I would not pay. She then stated she would go to the post office and get the exact shipping. I said OK. She then responded a few days later saying postage was $24 plus she was adding the ebay & paypal fees to it now making postage $29. She also sent a follow up message that she was not charging me for the shipping box & materials. That's what really set me off. I told myself do not respond with some negative type message that could put me on record as being hostile. So I decided I was going to pay but when the items arrived since they were described as brand new I would simply fold the corners on the packaging and claim the items were damaged and cause her a giant headache. But in the interim I talked to Mike Miller and he said he had never heard of such a thing especially the part of me paying the fees. He said keep a cool head and just cancel the order and see what happens. I also contacted ebay and they too advised me to cancel the order as she should not have tried to pass off the fees to me. I messaged her and told her to cancel the order she responded "good" and cancelled the order. It was not the $10 or so that I would have over paid but her attempt to screw over me that pissed me off.
I was happy that the items I won, but did not get, are all over ebay and not hard to replace at the same price. So all ended well.
 
The above doesn’t really answer the question. First, does the term full refund refer to shipping to the buyer. It may but it may not; the term is ambiguous. Secondly, even if it means shipping it to the buyer, it does not necessarily mean that the seller has to pay for the buyer shipping the product back to the seller.
 
Just a quick followup I have similier items that I already own that are exactly like what I ordered. I weighed them and approximated the size of the box. Then went to the USPS site to see the cost of shipping to her town ( she has it listed). Priority was $11.60 and she was trying to squeeze me for $29.

Gary...I'm glad that worked out...I hate it when people try to sneak a fast one by me...
 
You should write a book Gary about your Ebay adventures, "The Ebay Chronicles of Gary", it would be a NY Times best seller, have never seen a guy with so many situations on Ebay and each is different than the other.

I've had a few beauties in my dealings with people, but none of them top your stories, altought the guy who claims I sent him a pub scene and did not include the serving girls, the guy who said a figure arrived broken and when I asked him to send me a picture, he sent me a picture of a figure he did not buy from me and the guy who claimed a building I sent him arrived damaged when it looked like someone dropped it out of a tenth story window and I packed it as bomb proof, ie, all three of them are full of ****, aren't bad stories..................................

sold something on ebay to someone in US (from UK). arrived aok. buyer posted message on ebay saying thanks its arrived and its fine. job done.

almost 6m later they disputed the payment for it with their bank/credit card company. ebay contacted us. ebay said we need to prove the buyer received it. We said check their message saying thanks for the item arriving safe and well. ebay said the burden of proof from banks/credit card companies is higher than that - we need to have kept the post office receipt showing we posted it ! I said *** their message proves they got it how can they dispute it ??? as we didnt keep the postage receipt for 6m we were out of luck and ebay had to take the money off us and return it to the buyers bank/credit card. unbe******lievable.

now we keep all postage receipts for 6m but its never happened again.

I’m assuming you mean 6 months not 6 minutes. I keep my postal receipts for a few months but not that long. Did you enter the postal information in the eBay system. That would show package progress from dispatch until receipt. I do that immediately after I mail a package.
 
I didn't know you could block people from bidding like a member on this forum has done to me?
Don't know why bought one item off him and payed promptly it arrived no worries but now I can't bid on his items.
Emailed him but no explanation!!

Hi Wayne, yes you can block people, I have unfortunately had to do it multiple times due to multiple issues and hassles and scams. I would try emailing the person on the forum to find out why.
