So I bought this "MIB" WBritain carriage on Ebay, and when I received it, the rear undercarriage was severely bent and snapped, and their was significant paint loss on the bridal pieces, as well as the undercarriage. I would have need to solder it, then do a lot of painting, which would have ruined the value completely. So I contact the guy, provide photos, and say I will send it back for a **ll refund, as he advertised it as mint. I think I was very nice in my message, but what I got back was a lengthy accusation of me being a crook, telling me how annoying this is for him, accusing me of photographing another item, telling me to never buy form him again, telling me that Americans are stupid, etc.... I mean please, the item was very damaged, and was not as described:mad: Do people just disregard the person on the other end of the message?:(

so his theory is...

you bought the piece you wanted...

then you damaged it on purpose...

now you want your money back...

I had one similar on that on a rare BM-06 from a guy...

he told me to please file a claim with the postoffice...

I paid $165...he had it insured for $400...

a shady guy also I believe...

Contact ebay immediately as they are very buyer-friendly right now. Also, I always pay via paypal using a credit card, as the card will cancel the transaction with a bad faith seller even if paypal drags it's feet. Give all the details including that you have photos of the defective piece. Michael

Yeah that was it, but we worked things out. So essentially I sell the item (either retouched by me, or as is, on here, and he pays me the difference). So anyone for:
WB 00293 Queen Victoria in the Royal Barouche with attendants
(rear undercarriage is bent and partially broken off w/paint loss, bridal pieces have paint loss, and small undercarriage piece completely broken off)
(most repairs are simple bending, metal glue/solder, and paint retouching)
starting at $85, not including shipping, as this was a rare set. Make any offer-(hint-read the rest of the post)

I had the same trouble with some Trophy sets. First the seller accused me of the of breaking the soldiers and then he accused me of switching his good sets with my broken sets.

This guy had no clue on how to package toy soldiers.

This was my only bad purchase on EBAY.

I wouldn't fool around with this one. Send it back for a **ll refund within the time allowed or ebay/paypal will not help you. Why should you have to sell the item - especially when the original seller can still accuse you of selling it too cheap.

Once you resell the item, you have accepted his deal and ebay/paypal will no longer be involved.

Get a **ll refund well within the 45 days from sale and if needed, file a claim well before the expiry.

Once you resell the item, you have accepted his deal and ebay/paypal will no longer be involved.

Get a **ll refund well within the 45 days from sale and if needed, file a claim well before the expiry.

This is excellent advice. Sounds to me like the seller is trying to sucker you into getting rid of the evidence and proof of his bad faith deal. -- Al
 
The guy did write me back an email appologising for his words. I am in $75, but this guy is an auctioneer, and already apter the client, somhee would be out over 100 pounds. Because he has appologised, and he is a
fellow collector, he has offered this deal. He also offered to pay me back half price before hand instead. In would totally agree with you, but I do not want to make enemies. Also, I am waiting until things have cleared up before I (privatly) consider naming names. So considering what I spent, plus shipping, but minus $20-30 (so price minus shipping would be $60ish, is anyone interested? Or should I just... I don't know, any sujestions (he really did write a sincere appology....)

Sounds like he might be a fellow Treefrogger Forum Member, By the way of the reaction. He saw your post, Please do not make excuses for him, His apologies are a little too late. All the things He is doing right now, should have been his first reaction. secondly, This particular sellers, Needs to be weeded out of Ebay, And anything else that they are a member of. He should refund you everything at the very least. If he is really sorry, he should add a bit more, for causing this trouble.

No doubt Terry, I agree w/ your advice. How could the seller change his tune so quick (going from name calling to the trying to appear to be working things out, contingent on the buyer reselling damaged goods)?

report it to ebay and paypal and GET YOUR MONEY BACK! Don't worry about making an enemy out of somebody who has that kind of knee jerk reaction. That's not somebody worth knowing.

I've been hit with the "stupid American" thing too. Inexcusable. Just get your money back, private message his user ID so people can avoid him in the **ture.

If he is a member on the forum, maybe there should be an Apologies section on the forum where some of the hotter tempered people can make right with their fellow collectors and dealers. I know I am due a few apologies. :p
 
You were INTENTIONALLY misled. Now, he's trying to make amends for whatever reason.

1. Go after him on e-bay right now and get a **ll refund. You are entitled. As has been said below, ebay is very pro-buyer. Use that to your advantage. Hopefully you used a credit card. cancel the purchase on your cc immediately.
2. Leave this seller bad feedback if things are not settled completely to your satisfaction.
3. DO NOT repaint or sell it or take a reduced refund. He's trying to scam you for a second time.

Did you check his feedback ratings before you bought it? I'll bet he's done this before. And if so, show no mercy.
 
And... I would absolutely report the tirade to eBay. Include it in your "Item Not as Described" case. Really, there is no excuse for this seller.

It's one thing for a seller to make a mistake but quite another to abuse the buyer. Get him off eBay or at least sanctioned.

It's the seller responsability to send you a piece in good condition.

That's why you paid for the piece plus shipping and insurance.

Get a **ll refund including shipping.

He will ask his insurance company for a refund : not YOUR problem.

If one seller would accuse me of broking a piece like he did with you at first, I would get his name public for trolling..... We don't need that kind of seller on ebay.

Well...I am way too late to give any advice, but here's an interesting thing. I bought that same piece years ago when it came out...from a UK seller. The piece was brand new and arrived with various broken bits...including tracers. I think that piece must not travel well, and (pardon my being the Devil's Advocate here), it is possible, I would say, that it was not in fact broken when he shipped it but rather did not make the journey well. That, of course, does not excuse his response to your email or the action you should take, but it does leave open the possibility that the piece did break in transit.

The most important thing, of course, to learn from such an experience is: NEVER TELL ANYONE YOU ARE AMERICAN!! :D
