It behooves all of us to check our bank and credit card statements frequently. More and more, there are cases of ID theft, stolen card numbers, and "mistakes" like the ones mentioned here. We need to remian vigilant.
 
I've been talking today to someone who had large amounts double charged TWICE. On both occasions Rick Berry blamed a "staff member" for the over charge. Then a year after he said he would never deal with Michigan Toy Soldier again, his credit card was charged out of the blue! This time, apparently Rick Berry "wasn't even there". The money was re-embursed but not until the threat of legal action!
Personally if I had ever delt with them I would be checking all my bank statements and changing any card details I'd given them!
Another thing that has gone unnoticed. If he ran his business into the ground so much that he needed to steal money to support it. He has done so while under-cutting and therefore taking customers from reputable traders both in the U.S and U.K. My sympathy is with them.
So if you think it was all just a mistake that's up to you.

I'm hearing more and more people mention 'mistakes' in charging there. I wonder how big this was?
 
Mistakes my ar*e!!!!

I was once charged 20 more than I should have at one online place but, I was charged a price that had been on the item only hours before so, IMO thats a mistake and, it was rectified by the store and, as an apology I was given a full refund for the item. The nonsense which started this thread was deliberate and not a mistake anyone who thinks these actions are mistakes is being polite (for no reason) or, is rather stupid.

Its right to keep a real good eye on your cash.

I wonder what the impact is on buying new Del Prado figures, too. Michigan Toy Soldier Co. is the official US agent for the line.

I would be looking for another dealer in the US as scandal always sticks and no brand is going to want to be associated if they are reputable and want their image to remain so.

In 2010 there were several small product lines that we made the decision to discontinue. ONTC was one of them.
 
Sentencing is to take place next Monday, February 7, 2011, before U.S. District Judge Robert Cleland.
 
Hopefully, he will have the sentencing and punishment ethos of the man who appointed him

In our Constitutional system, Federal judges are nominated by the President but approved by the Senate. Judge Cleland was nominated by the first President Bush in 1990 and approved by the Senate a few months later. U.S. sentencing guidelines dictate how much time a person has to serve in prison.
 
Well, it means that Bush was not exactly soft in terms of what punishment should be met out to criminals.

That is true but the law and sentencing guidelines provide for what the Judge can do.

Of course, but, we know that judges have autonomy within the statutory guidelines to decide what the sentence can and will be i.e. the maximum the statute offers or the lowest or average. We do in the UK have such judges and I am certain you do in the US.

the UK trade bongo drums are drumming and it would appear that the over charge scam has been done to a few UK dealers as well................Gun in hostle......BANG there goes the foot.shame as it takes down more than just a man it takes down the family, reputation the name and the hobby!!
 
I just can't see what gain was? (well, cash obviously but, you know what I mean) you always are found out, its only a question of time so, why bother???

I would accept the loss if I was the victim in exchange for twenty years....Of course, but, we know that judges have autonomy within the statutory guidelines....he should not be allowed to run a business again, an untrustworthy individual plain and simple

No one is arguing for more sympathy. But 20 years of prison is not something we give those who have committed non-violent crimes, for the most part. We dont have the space or money for it, frankly. Crimes of violence are much more dangerous to society than "mere" electronic theft, and we must reserve suffiicent resources to keep all those folks locked away.

Judges have flexibility, not autonomy. Dont know the actual criteria, but likely relates to degree of mischief, previous behavior, genuine remorse expressed, and likelihood to repeat. Somewhat but not totally subjective.

US laws do not prohibit convicted felons from owning or running legitimate businesses (unless perhaps something that requires licenses, like medical or financial). We want crooks to pay for their crimes, but also have reasonable options for making a life for themselves after doing so. Having a criminal background is not easily overcome. Many businesses are reluctant to hire, banks dont extend credit, previous customers are not likely to return, etc. No need for massive govt oversight, the free markets ensure punishment is lasting and instructional :)
