All this talk about rehabilitaion, great! the facts are he got caught doing the same thing in 1993 and didn't learn a thing! By being able to continue in the business and have the opportunity to do it again suprise! suprise! he did it again!! IN SPADES!!!
Sorry his credibility is null and void... be gone... there are good hard working honest people who will fill the void if there is a demand.
I still only feel for the good employees who will lose there jobs in one of the worst run, highest unemployment states in the union.
 
From the news reports, the store opened in 1990. There was a similar conviction for credit fraud in 1993 - I don't remember that being a poor economic year. The Peter Jackson incident happened in 2007, that was before the recession and in the Golden age of TS collecting. At some point, MTS lost their K&C franchise for discounting apparently large quantities of models. And I have been told that a few other people have had their credit cards charged fraudulently, one person twice for large amounts.

There seems to be a pattern here. The 1993 rehabilitation didn't seem to work very well. Sending out the wrong model is a mistake. Repeated credit card frauds are not a mistake - they are deliberate acts.

The majority of crimes are by repeat offenders. Rehabilitation rarely works with repeat offenders.

Then that further strengthens my stance that he should be jailed and the key thrown away. Obviously, a morally redundant character and one which deserves absolutely no sympathy whatsoever.

Its rather insulting to the hard working people who have lost jobs and are scraping by and not stealing when the recession is used as an excuse for this behaviour and IMO an outrageous defence as this has nothing to do with it whatsoever. But, there is always someone making excuses for people who are inexcusable.

I would accept the loss if I was the victim in exchange for twenty years

Absolutely.

Trial by forum is not something that appears in any judicial system that I'm aware of. That's the Court's job, which will be carried out in February.

Forum members will obviously have their own opinions, but it would be worth considering, it's not just Rick Berry who views these pages. It's his friends, associates and daughters.

If people genuinely feel for his family and work colleagues, then why don't they give this a rest and let the judicial system work out the intricacies of sentencing.

I don't think this was in anyway shape or form trial by forum as has been stated. Are we not awaiting sentence not trial???? The minutia has been decided and guilt established. What is being discussed is the punishment, rehabilitation and restitution. This is based on the facts of the case. Some are more leniant some not so.

I was responding to comments that I thought undermined the seriousness of this matter and, with the greatest of respect to forum members on a different page to me I believe the individual has brought greater problems to friends family and associates than anything we could discuss

This was the point that I was trying to make earlier but didn't do it particularly well.

Totally agree! Lets see how things go, and try not to offend those who are close to him, as they did not do anything wrong, and we don't want to hurt them more than they already have been.
 
I think as Alan said earlier we've established that most folk are either in the hang em and flog em brigade or the forgive and forget dept, we could go on like this until the Cows come home so maybe its time to move on. My friend Simon makes a very good point, can't be easy for his family to read this stuff and they are innocent victims here too,whatever we think of the crime.

I only know what I have read on here...but I'm shocked...what a nice group of people on here...

it would have been discovered and made public anyway...

I was charged twice for one purchase by him, some time ago. I called him right away and I was refunded the overcharge. I see I wasn't alone...
 
What seems to have slipped a lot of minds is that this guy has our - including mine - credit card details. What was to stop him selling a few of them off to total crooks? My observations of theft (working at a bank for 15 years) is that not getting caught at the start encouraged bigger thefts. Indeed a certain arrogance came into it. So I'm with the 'hang-em' crowd. To lable it just a 'mistake' is almost a fraud in itself. He chose to steal.
 
I've been talking today to someone who had large amounts double charged TWICE. On both occasions Rick Berry blamed a "staff member" for the over charge. Then a year after he said he would never deal with Michigan Toy Soldier again, his credit card was charged out of the blue! This time, apparently Rick Berry "wasn't even there". The money was re-embursed but not until the threat of legal action!
Personally if I had ever delt with them I would be checking all my bank statements and changing any card details I'd given them!
Another thing that has gone unnoticed. If he ran his business into the ground so much that he needed to steal money to support it. He has done so while under-cutting and therefore taking customers from reputable traders both in the U.S and U.K. My sympathy is with them.
So if you think it was all just a mistake that's up to you.
